1. About these Terms

These Terms and Conditions (“Terms”) govern your use of the WinPrey Guardian mobile application (“App”), operated by Winprey Pvt Ltd, a company registered in India with its office at Kumhrar, Patna – 800002 (“Winprey”, “we”, “us”).

By signing in to or using the App, you agree to these Terms and to our Privacy Policy at [Privacy Policy URL]. If you do not agree with these Terms, please do not use the App.

2. Who can use the App

  1. The App is intended for parents, guardians or other authorized persons responsible for a child/student who uses a school bus, van or other transportation service supported by Winprey.
  2. You must have the necessary authority or permission to access information relating to the child/student whose information you view through the App.
  3. Your account may be created or approved by your school, institution, transport operator or Winprey.
  4. You must provide accurate and current information when registering or using the App.
  5. Winprey may restrict or refuse access where it has reason to believe that a person is not authorized to access a child’s information.

3. Your account

  1. Keep your login details private and do not allow another person to use your account.
  2. You are responsible for activity carried out through your account.
  3. Inform your school, transport operator or Winprey at winpreyapp@gmail.com immediately if you believe your account has been compromised or misused.
  4. The information you provide, including your name, phone number, email address and other account information, must be accurate and kept up to date.
  5. You must not share your account or login credentials with unauthorized persons.

4. Child and journey tracking

  1. The core purpose of WinPrey Guardian is to allow authorized parents and guardians to view information about a child’s school-going and return journey.
  2. Depending on the services enabled for your school or transport operator, the App may display information such as:
    • Child/student details
    • Pickup address
    • Drop address
    • Current location
    • Bus or van location
    • Vehicle route
    • Journey status
    • Pickup and drop status
    • Relevant journey updates or notifications
  3. Location information displayed in the App is received from the Winprey system and/or the associated driver/vehicle tracking system.
  4. Location information may not always be perfectly accurate or continuously available. It may be affected by GPS availability, mobile networks, internet connectivity, device conditions or other technical factors.
  5. The App is intended to provide journey visibility and assistance. It should not be treated as a substitute for parental supervision, emergency services, school procedures or responsible adult judgment.
  6. You should not rely solely on the App for emergency or life-critical situations.
  7. Journey and location information may be retained for [X days], subject to the applicable service requirements, safety requirements, contractual requirements and applicable law.
  8. Winprey may retain certain records for longer where reasonably necessary for legal compliance, security, dispute resolution, safety incidents or other legitimate purposes.

5. Use of location information

  1. Location information is provided to authorized users for the purpose of supporting school transportation and child journey monitoring.
  2. You must use location information only for legitimate purposes connected with the child’s school transportation and safety.
  3. You must not use, copy, record, publish, distribute or otherwise misuse a child’s location or journey information.
  4. You must not share screenshots, live location information, route information, pickup/drop addresses or other sensitive information with unauthorized persons.
  5. Winprey does not permit the use of the App to track or monitor any person who is not authorized or associated with the relevant school transportation service.

6. Personal data and privacy

  1. We collect and process personal information as described in our Privacy Policy and in accordance with applicable Indian law.
  2. Information relating to children and their journeys is handled with appropriate care and is made available only to authorized users and service providers as necessary for providing the service.
  3. Information may include, where applicable:
    • Guardian name
    • Guardian contact details
    • Student name
    • Student/student ID
    • School information
    • Pickup and drop information
    • Journey information
    • Location information
    • Vehicle/route information
    • App and device information
  4. We use this information to provide, operate, secure and improve the WinPrey service and to support school transportation and journey management.
  5. We do not sell personal information to third parties.
  6. Location information is not intended to be used for advertising.
  7. You may contact us to request access, correction or deletion of personal information, subject to applicable law and any information that we are required or permitted to retain.

7. Your responsibilities as a Guardian

You agree to:

  1. Use the App only for legitimate child/student transportation monitoring.
  2. Keep your login credentials secure.
  3. Provide accurate account information.
  4. Use the child’s location and journey information responsibly.
  5. Not share the child’s personal information, location, route or pickup/drop information with unauthorized persons.
  6. Immediately report any suspected unauthorized access, incorrect information or security issue to Winprey or the relevant school/transport operator.
  7. Follow the rules and instructions of the relevant school, institution and transport operator.

8. Things you must not do

You must not:

  1. Use the App to track a person without proper authorization.
  2. Share or misuse student, guardian, driver, vehicle or route information.
  3. Use the App for stalking, harassment, intimidation or any unlawful purpose.
  4. Attempt to obtain access to another guardian’s or student’s information.
  5. Attempt to hack, reverse engineer, overload, disrupt or damage the App or Winprey servers.
  6. Circumvent security or access controls.
  7. Upload or transmit false, harmful, illegal or malicious content.
  8. Use automated tools to access or collect information from the App without authorization.

9. Accuracy of location and journey information

  1. Winprey makes reasonable efforts to provide accurate journey and location information.
  2. However, location information depends on GPS, mobile networks, internet connectivity, device hardware, driver/vehicle systems and other technical factors.
  3. Therefore, Winprey does not guarantee that location information will always be:
    • Accurate
    • Continuous
    • Available
    • Real-time
    • Error-free
  4. A displayed location may be delayed or temporarily unavailable.
  5. If the App shows incorrect or unavailable information, the guardian should contact the relevant school or transport operator where appropriate.

10. Ownership

The App, its design, code, graphics, logo, content and the name “Winprey” belong to Winprey Pvt Ltd or its applicable licensors.

We provide you with a limited, non-exclusive, non-transferable right to use the App for its intended purpose while your account remains authorized and these Terms apply.

11. Service availability

We will make reasonable efforts to keep the App available and functioning.

However, the service may occasionally be unavailable or interrupted because of:

  • Internet/network problems
  • GPS problems
  • Device problems
  • Server maintenance
  • Software updates
  • Security incidents
  • Third-party services
  • Technical failures
  • Circumstances outside our reasonable control

We may update, modify, suspend or discontinue features of the App where reasonably necessary.

12. Limitation of liability

  1. The App is provided on an “as available” basis.
  2. To the extent permitted by applicable law, Winprey is not responsible for indirect or consequential losses resulting from:
    • Network failure
    • GPS inaccuracies
    • Delayed location information
    • Incorrect information provided by users
    • Device failure
    • Misuse of the App
    • Unauthorized sharing of account credentials
    • Actions of schools, transport operators, drivers or other third parties
  3. Winprey does not replace the responsibilities of parents, guardians, schools, institutions, transport operators or drivers.
  4. The App is a technology and journey-monitoring tool and should not be considered an emergency response service.
  5. Our total liability to you for any claim will be limited to [INR amount], to the extent permitted by applicable law.

13. Suspension and termination

  1. Winprey, the relevant school or transport operator may suspend or terminate your access if:
    • You breach these Terms;
    • You misuse the App;
    • You are no longer an authorized guardian/user;
    • Your relationship with the relevant school or transport service ends;
    • Access is required to be suspended by law or for security reasons.
  2. When your account is terminated, your access to the child’s journey and location information will stop.
  3. Personal information will be handled in accordance with our Privacy Policy and applicable legal requirements.

14. Changes to these Terms

We may update these Terms from time to time.

When we make important changes, we may notify you through the App or other appropriate means.

The updated Terms will show a new “Last updated” date.

Your continued use of the App after the updated Terms become effective means that you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of India.

Any dispute arising from these Terms or your use of the App will be subject to the jurisdiction of the competent courts at Patna, Bihar, subject to applicable law.

16. Grievance Officer

As required under applicable Indian law, complaints or grievances relating to the App or personal data may be sent to:

We will acknowledge complaints within 24 hours and aim to resolve them within 15 days, subject to the nature of the complaint and applicable law.
