Terms and Conditions: Winprey Driver

1. About these Terms
These Terms and Conditions (“Terms”) govern your use of the Winprey Driver mobile application (“App”), operated by Winprey Pvt Ltd a company registered in India with its office at [Registered Address] (“Winprey”, “we”, “us”). By signing in to or using the App, you agree to these Terms and to our Privacy Policy at [Privacy Policy URL]. If you do not agree, do not use the App.
2. Who can use the App
1. The App is only for bus and van drivers engaged by a school, institution or transport operator (“Operator”) that uses Winprey.
2. You must be at least 18 years old and hold a valid driving licence for the vehicle you drive.
3. Your account is created by your Operator or by Winprey. You cannot create an account yourself.
3. Your account
1. Keep your login details private. Do not let anyone else use your account.
2. You are responsible for all activity under your account.
3. Tell your Operator or us at [support email] at once if you think your account has been misused.
4. The information you give (name, phone number, licence, Aadhaar, PAN, bank details, photo) must be true and up to date.
4. Location tracking
1. The App’s core purpose is to share the live location of your vehicle with your Operator and with parents and guardians of students on your route.
2. To do this, the App collects your device’s precise location about every [10] seconds while you are on duty or a trip is active. This includes when the App is closed, in the background, or the screen is off.
3. A notification stays visible on your phone while tracking is running.
4. Location is used only for live tracking, trip history, route management and student safety. It is not used for advertising and is not sold.
5. You can stop tracking by ending your trip or going off duty in the App, or by turning off location permission. If you turn off location while on duty, the App cannot work and your Operator may be informed.
6. Location history is kept for [X days] and then deleted, except where the law or a safety incident requires us to keep it longer.
5. Your duties as a driver
1. Do not use the App while the vehicle is moving. Start or end trips only when safely parked.
2. Follow all traffic laws, the Motor Vehicles Act, 1988, and your Operator’s rules at all times.
3. Keep your phone charged, with location and internet turned on, during duty hours.
4. Do not fake, block or tamper with your location (for example with GPS spoofing apps).
5. The App is a support tool. It does not replace your own judgement or your responsibility for student safety.
6. Personal data
1. We collect and handle your data as described in our Privacy Policy, in line with the Digital Personal Data Protection Act, 2023 and other applicable Indian law.
2. Identity and bank details are used only to verify you and for your Operator’s records or payments. They are never shown to parents.
3. We share your name, vehicle details and live location with your Operator and with the parents or guardians of students on your route.
4. We do not show ads in the App, do not use an advertising ID, and do not sell your personal data.
5. You can ask to see, correct or delete your data by writing to [privacy email]. Some data may be kept where the law requires it.
7. Things you must not do
1. Use the App for anything other than your work as a driver for your Operator.
2. Copy, share or misuse any student, parent or route information you see.
3. Try to hack, reverse engineer, overload or break the App or its servers.
4. Upload false, harmful or illegal content.
8. Ownership
The App, its design, code, logo and the name “Winprey” belong to Winprey pvt ltd . We give you a limited, non-transferable right to use the App only for your work while these Terms apply.
9. Service availability
We try to keep the App working at all times, but location updates depend on your phone, GPS signal and mobile network. We do not promise the App will be error-free or always available, and we may update or change features at any time.
10. Limitation of liability
1. The App is provided “as is”. To the extent the law allows, Winprey is not liable for indirect or consequential losses, or for losses caused by network failure, wrong location data, or your misuse of the App.
2. Winprey is not responsible for accidents, traffic violations or the driving itself. These remain the responsibility of the driver and the Operator.
3. Our total liability to you for any claim is limited to [INR amount].
11. Suspension and termination
1. Your Operator or Winprey may suspend or close your account if you break these Terms, leave your Operator, or if required by law.
2. When your account is closed, location tracking stops and your data is handled as set out in our Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. We will show the new date at the top and tell you in the App for important changes. Continuing to use the App means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of India. Any dispute will be handled by the courts at Patna.
14. Grievance Officer
As required under the Information Technology Act, 2000 and its rules, complaints can be sent to:
